How do I obtain a divorce?
The most advisable way is to seek advice from a solicitor
as a divorce petition must be presented to court in a
certain format and must contain certain wording that is
acceptable to the court.
Will a divorce mean I have to go to court?
No. attendance at court is unnecessary unless the
person responding to the divorce wants to defend the
divorce petition lodged at court (this is quite rare).
Attendance at court is required if financial proceedings
need to be resolved by the court.
How long does a divorce take?
A straightforward divorce (not including resolution
of financial matters) can take between 4-6 months. |
|
What are ancillary relief proceedings?
When couples divorce, issues such as money held as equity
in the home, savings, pensions and any other assets
need to be divided, this can be a difficult and complicated
process and in the absence of agreement as to distribution
of these assets the Court is sometimes forced to make
a decision as to distribution. The financial element
of divorce is therefore known as ancillary relief.
We aim to achieve settlement without the need to issue
proceedings as court can be costly and lead to delay.
We would aim to reach settlement through negotiation
and mediation.
