Speeding, notices of intended prosecution and notices
asking for driver details.
This is possibly the most contentious area facing motorists
today. The proliferation of fixed and mobile devices means
that more and more of us are receiving ‘notices
of intended prosecution’ and requests to provide
information as to the identity of the driver at a particular
time in order that that person may be pursued in a speeding
prosecution.
Failing to respond to these notices can lead a prosecution
and to the imposition of 6 points – often more points
than for the speeding offence itself.
A notice of intended prosecution must be served within
a certain time of the offence (if not then the case cannot
proceed), at the same time there is usually a request
under s172 of the Road Traffic Act 1988 for details of
the identity of the driver at the time of thew offence.

In order to secure a contended speeding case the prosecution
can often find themselves in difficulty if procedures
have not been followed properly or if the reliability
of machinery is challenged. Officers can be challenged
to satisfy the courts that machinery has been properly
operated and calibration checks made.
It is imperative to understand the relevant procedures,
protocols and devices in order to challenge a speeding

Speeding carries a mandatory minimum 3 penalty points
and a discretionary disqualification. The courts have
guideline penalties depending upon the speed and circumstances
alleged (For example the guideline is to consider disqualification
if driving at 100mph or more on the motorway).
If speeding is conceded you may find yourself with a totting
disqualification of 6 months unless you are able to successfully
argue exceptional
hardship.
